1. About these Terms

These Terms of Use (“Terms“) are an agreement between you and Rocketo (“Rocketo“, “we“, “us“), Morbi, Gujarat, India. They apply when you visit https://rocketo.in (the “Website“) or use Rocketo, our online billing, inventory, barcode and GST software for cracker and fireworks shops (the “Service“).

By creating an account, paying for the Service, or using the Website or the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Website or the Service.

These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it. They are generated by a computer system and do not need a physical or digital signature. They are published in line with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, to the extent applicable.

2. Definitions

  • Shop Owner means the person or business that buys a subscription to the Service for a shop.
  • Staff means any person the Shop Owner gives a login to under their shop account.
  • User or you means any person who uses the Website or the Service, including Shop Owners and Staff.
  • Shop Data means all information entered, uploaded, created or stored in the Service by or for a shop. This includes items, prices, MRP, rates, stock, HSN codes, tax rates, GSTIN, bills, amounts, payments, dues, customer names and mobile numbers, staff details, reports and activity logs.
  • Subscription means the paid right to use the Service for one shop for the period paid for.

3. What Rocketo provides and what it does not

Rocketo is a software tool only. We provide the software, its structure (screens, fields, calculations, reports and print formats) and the hosting needed to run it. You decide what to enter into it and how to use it.

Rocketo does not:

  • sell, buy, store, transport or deal in crackers, fireworks or any other goods;
  • take part in any sale between a shop and its customers, or collect money on a shop’s behalf;
  • check, approve or verify any Shop Data, prices, tax rates, HSN codes, GSTIN or bill amounts;
  • give legal, tax, GST, accounting or financial advice; or
  • file any GST return, tax return or government form for you.

Tax calculations, GST summaries, HSN summaries and other reports in the Service are aids based on the data you enter. Always have your chartered accountant or tax consultant check them before you file any return or rely on them.

4. Who can use the Service

  • You must be at least 18 years old and able to enter into a contract under the Indian Contract Act, 1872.
  • The Service is for business use by shops. It is not meant for personal or household use.
  • If you use the Service for a business, you confirm that you have the authority to accept these Terms for that business.

5. Accounts, logins and staff

  • You must give correct details when your account is created and keep them up to date.
  • You are responsible for keeping all passwords safe. Do not share your login with anyone.
  • The Shop Owner decides who gets a Staff login and what each Staff member can do. The Shop Owner is fully responsible for every action taken by their Staff in the Service.
  • Remove a Staff member’s access as soon as they leave your shop.
  • Tell us at once at info@rocketo.in if you think someone has used your account without permission. We are not responsible for loss caused by use of your login by anyone else, unless it was caused by our own fault.

6. Shop Data belongs to the Shop Owner, and so does the responsibility

Ownership. All Shop Data belongs to the Shop Owner. We do not claim any ownership of it.

Permission to process. You give Rocketo a limited permission to store, process, back up, display and print Shop Data only to provide, secure and support the Service for you, and as required by law. We do not sell Shop Data.

The Shop Owner alone is responsible for all Shop Data. This includes:

  • the accuracy and completeness of every item, price, MRP, rate, discount, stock quantity, tax rate, HSN code and GSTIN entered;
  • every bill, amount, payment, due and receipt created in the Service, and every document printed or shared from it;
  • the personal details of customers and Staff entered in the Service, and having a lawful reason and any consent needed to collect and use them;
  • following the Digital Personal Data Protection Act, 2023 as the Data Fiduciary for their customers’ and Staff’s personal data, including answering their requests;
  • charging and paying the correct GST and other taxes, issuing correct tax invoices, and filing returns on time;
  • keeping their own copies of bills, GST records and books of account for the period required by law (for GST, generally 72 months); and
  • any dispute with a customer, supplier, Staff member, tax authority or other person about a sale, bill, amount or record.

Rocketo is not responsible for any wrong, incomplete or unlawful Shop Data, or for any tax, penalty, interest, loss or claim that arises from it.

7. Licences and legal compliance of the shop

Selling fireworks is regulated in India. The Shop Owner confirms that they hold, and will keep valid, every licence and permission their business needs, including any licence under the Explosives Act, 1884 and the Explosives Rules, 2008, GST registration where required, and local trade or fire licences.

The Shop Owner must follow all laws, court orders and government directions that apply to their business, including rules about which fireworks may be sold, where, when and to whom. Rocketo does not check any of this and is not responsible for it.

8. Acceptable use

You must not use the Website or the Service to host, display, upload, change, publish, send, store, update or share any information that:

  1. belongs to another person and to which you have no right;
  2. is obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, racially or ethnically objectionable, relates to or encourages money laundering or gambling, or promotes enmity between groups on the grounds of religion or caste with the intent to incite violence;
  3. is harmful to children;
  4. infringes any patent, trademark, copyright or other proprietary right;
  5. deceives or misleads about where a message came from, or knowingly and intentionally shares misinformation or information that is patently false and untrue or misleading in nature;
  6. impersonates another person;
  7. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to any cognisable offence, or prevents the investigation of any offence, or insults another nation;
  8. contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource; or
  9. violates any law in force.

You also must not:

  • use the Service to create fake, backdated or false bills or tax invoices, or for tax evasion or any fraud;
  • try to access another shop’s data, our servers or any part of the Service you are not allowed to use;
  • copy, sell, resell, rent, sub-license or share the Service with any other shop or person;
  • reverse engineer, decompile or try to extract the source code of the Service, except where the law allows it;
  • overload, disrupt, test the security of, or attack the Service; or
  • use bots, scrapers or automated tools on the Website or the Service without our written permission.

We may remove content or suspend access that breaks this Section, and we may report unlawful activity to the authorities.

9. Fees and payment

  • The Subscription fee is shown on the Website (currently ₹4,999 per shop per year). Any applicable taxes will be shown on our invoice.
  • Fees are paid in advance, directly to us by UPI or bank transfer. Your Subscription starts when we confirm the payment and activate your account, and it runs for the period paid for.
  • One Subscription covers one shop. A second shop or branch needs its own Subscription unless we agree otherwise in writing.
  • Subscriptions do not renew automatically. To continue, pay the renewal fee before the Subscription ends.
  • We may change our prices for future periods. A new price applies only from your next renewal, not to a period you have already paid for.
  • If a payment is not received, or is reversed, we may suspend the account until it is paid.

10. Free demo and refunds

We offer a free demo so you can see the Service before you pay. Because of this, fees are non-refundable once your account has been activated, including for any unused part of a Subscription, except where Indian law requires a refund or where we cannot provide the Service because of our own fault.

11. Availability, updates and support

  • The Service runs online and needs a working internet connection and a supported browser. It does not work offline.
  • We try to keep the Service available at all times, but we do not promise that it will be uninterrupted, error-free or available at any particular time, including during festival seasons.
  • We may take the Service down for maintenance, updates or security reasons, and will try to do this at quieter times.
  • We may improve, change or remove features of the Service. We will not remove a core feature you have paid for during your current Subscription without a reasonable alternative.

12. Backups and your own copies

We take regular backups of the Service to protect against technical failures. Backups are for our system recovery and are not a record-keeping service for you. The Shop Owner must regularly export and keep their own copies of bills, GST reports and other important records. We are not responsible for loss of Shop Data you have not exported, except where the loss is caused by our gross negligence.

13. Hardware, browsers and third-party services

Barcode scanners, printers, phones, computers, internet connections and browsers are not provided by Rocketo. We are not responsible for their faults, compatibility or cost. The Service may use third-party services such as our hosting provider and Google Fonts. Their availability and terms are outside our control.

14. Our intellectual property

The Website and the Service, including their software, design, screens, layouts, print formats, text, logos and the name “Rocketo”, belong to Rocketo and are protected by Indian and international law. During your Subscription, we give you a limited, non-exclusive, non-transferable licence to use the Service for your own shop’s business. No other right is given to you.

If you send us suggestions or feedback, we may use them to improve the Service without any obligation to you.

15. Privacy

Our Privacy Policy explains how we handle personal data. For Shop Data about customers and Staff, the Shop Owner is the Data Fiduciary and Rocketo acts only as a Data Processor on the Shop Owner’s instructions.

16. Suspension and termination

  • You may stop using the Service at any time by telling us at info@rocketo.in. Fees already paid are not refunded (Section 10).
  • We may suspend or close your account, with notice where reasonable, if you break these Terms, do not pay, use the Service unlawfully, or if a law, court or government authority requires it.
  • When a Subscription ends or an account is closed, access stops. We keep the Shop Data for 30 days so you can export it, and then erase it within the next 60 days, except where the law requires us to keep it. Please export your data before your Subscription ends.
  • Sections 6, 12, 14 and 17 to 22 continue to apply after termination.

17. Disclaimer

The Website and the Service are provided on an “as is” and “as available” basis. To the extent allowed by law, we do not give any warranty that the Service will meet your needs, be free of errors, or that any calculation, report or printed document will be suitable for any legal, tax or accounting purpose. You use the Service at your own judgement and risk.

18. Limitation of liability

To the extent allowed by law:

  • Rocketo is not liable for any indirect, incidental, special or consequential loss, including loss of profit, sales, business, goodwill or data, or any tax, penalty or interest, however it arises.
  • Rocketo is not liable for any loss arising from Shop Data, the acts of the Shop Owner or their Staff, a shop’s dealings with its customers, or the failure of hardware, internet or third-party services.
  • Rocketo’s total liability for all claims relating to the Website or the Service is limited to the fees you paid us for the Service in the 12 months before the event that caused the claim.

Nothing in these Terms limits any liability that cannot be limited under Indian law.

19. Indemnity

The Shop Owner agrees to protect and compensate Rocketo against any claim, demand, penalty, loss or cost (including reasonable legal fees) made by any customer, Staff member, tax or government authority or other person that arises from:

  • Shop Data, or any bill, amount, tax or record created with the Service;
  • the shop’s business, sales, licences or legal compliance;
  • any act or omission of the Shop Owner or their Staff; or
  • a breach of these Terms or any law by the Shop Owner or their Staff.

20. Events outside our control

We are not responsible for any delay or failure caused by events outside our reasonable control, such as natural disasters, fire, flood, epidemic, war, riots, strikes, power or internet failures, failure of hosting or other service providers, cyber attacks, or government action.

21. Changes to these Terms

We may update these Terms when the law or the Service changes. The latest version will always be on this page with its “Last updated” date. By continuing to use the Website or the Service after a change, you accept the updated Terms. If you do not agree, stop using the Service.

22. General

  • Governing law. These Terms are governed by the laws of India.
  • Disputes. If there is a dispute, please contact us first. Both sides will try in good faith to settle it within 30 days before taking any other step.
  • Whole agreement. These Terms and the Privacy Policy are the whole agreement between you and Rocketo about the Website and the Service.
  • Severability. If any part of these Terms is found invalid, the rest stays in force.
  • No waiver. If we do not enforce a right at once, we do not give it up.
  • Transfer. You may not transfer your account or these Terms to anyone else without our written consent. We may transfer them as part of a merger, sale or restructuring of our business.
  • Notices. We may send notices to the email or mobile number on your account. You can send notices to info@rocketo.in.
